The cleaning services that we will complete at your premises will be clearly specified to you at the time of quotation and can include floor buffing and polishing, carpet cleaning, window cleaning and fogging, which is more fully explained on this website under Home Cleaning.

GENERAL TERMS AND CONDITIONS OF TRADE

COMMERCIAL CLEANING

  • 1. The following terms and conditions apply to all products and services supplied by mint Cleaning Services hereinafter referred to as mint.
  • 2. Acceptance of this quotation shall be deemed to be acceptance of these conditions.
  • 3. Notwithstanding clause 1.1 mint. may by written notice to the Customer alter or replace these terms and conditions. All agreements/quotations placed subsequently by the Customer shall be upon the altered or replaced terms and conditions.
  • 4. These terms and any terms set out by mint shall be included as terms in any agreement resulting between parties and in the case of any conflict arising between these terms or the terms of the Customers order, then these terms and conditions shall prevail.
TERMS AND CONDITIONS OF PRICES AND AGREEMENTS/ORDERS
  • 1. All prices are exclusive of GST unless otherwise stated.
  • 2. No order shall be binding on mint. until accepted in writing by mint. or a person authorized on its behalf.
TERMS AND CONDITIONS OF PAYMENT
  • 2. Payment is due on or before 20th of the month following the date of the invoice and payment is to be made without deduction or set off, in cash, by cheque or direct credit into mint’s bank account.
    (Please note that the monthly payment is calculated as one twelfth of the annual charge quoted irrespective of the number of actual cleans in a particular month. It is possible that over the January/ February period as few as 2 cleans per month will be completed, but this has also been allowed for in the quotation).
  • 3. Where any payment is not made on the due date, then without prejudice to any other rights or remedies available to mint. under these terms and conditions or at law or in equity or otherwise mint. may:
    • a) Charge interest by way of liquidated damages on all overdue accounts at the rate of 2% per month calculated on a daily basis from the date on which payment was due until payment is made in full;
    • b) Withhold services or cancel uncompleted agreements or portions of such and retain as liquidated damages any monies paid by the Customer and sue the Customer for damages;
    • c) Cancel any other order or agreement or arrangement between mint. and the Customer.
    • d) The Customer shall upon demand reimburse mint for all costs (including legal costs on a solicitor/client basis), expense or other sums incurred by mint in the recovery of the monies due and /or the materials or products, which sum shall also carry interest at the rate specified in Clause 3.2.1, if unpaid within one calendar month of the demand having been made.

REGULAR HOME CLEANING

  • 9. These general terms and conditions relate to a contract for the provision of cleaning services by Integra Management Limited and for the customer named on this quotation.
  • 10. The following terms and conditions apply to all products and services supplied by Integra Management Limited, trading as mint. Home Cleaning and hereinafter referred to as “mint. Home Cleaning” or “the supplier” or “the franchisor”.
  • 11. The contract is between the customer and the supplier, but the operational performance of the contract will be satisfied by a franchisee of the mint. Home Cleaning franchise, for which Integra Management Limited is the franchisor.
  • 12. The customer or the supplier can change the franchisee responsible for the operational performance of the contract by giving two cleans’ notice of the required change (This is effectively 2 weeks’ notice for a weekly cleaning service and 4 weeks’ notice for a fortnightly cleaning service).
  • 13. The customer may cancel the cleaning contract between the customer and the supplier by giving two cleans’ notice, as specified in 4. above.
  • 14. All prices are inclusive of GST unless otherwise stated.
  • 15. The customer accepts that when assessing the competitiveness of a cleaning contract it is based on total cleaner-hours and that the larger the cleaning team (1, 2 or 3 cleaners) the quicker they will be finished.
  • 16. Acceptance of this quotation shall be deemed to be acceptance of these conditions.
TERMS AND CONDITIONS OF PAYMENT
  • 17. Payment is due a maximum of 3 working days from the date of invoice and payment is to be made without deduction or set off, in cash, by cheque or by direct credit to the franchisee who performed the cleaning service and whose details are on the invoice supplied.
  • 18. The supplier advocates that the payment to the franchisee be made on the day in which the cleaning service is performed and by Direct Credit to the nominated account of the franchisee. However, the customer and the franchisee shall have the right to alter the terms of payment by mutual agreement. The customer will notify the supplier of any such change in the terms of payment.
  • 19. Where any payment is not made on the due date, then without prejudice to any other rights or remedies available under these terms and conditions or at law or in equity or otherwise, the supplier may:
    • c) Withhold cleaning services or cancel uncompleted services or portions of such and retain as liquidated damages any monies paid by the Customer and sue the Customer for damages.
    • d) Cancel any other order or agreement or arrangement between the supplier and the Customer.
